We believe that you should know from the outset how much you are going to have to pay for our services.

Our Fees

Fees – General

Whilst we fully understand that you will want to know how much our fees will be, we at KK Law will not agree a fixed fee with you if you call and ask for one. The reason being is simple, we are not a ‘factory’ where ‘one size fits all’. We tailor our service to your particular needs. We therefore need to evaluate the issues first. After we have all the information which we will consider carefully, we will provide you with an estimate of your likely legal costs, based on the information provided.

When you contact us, we will offer an initial meeting with you. At that meeting we will discuss, in some detail, how we can work with you. We will then evaluate the information and contact you within a few days with an outline of the work involved and an estimate for the likely costs. We charge a fee for the initial meeting of £100.00 + VAT, payable at the time of the meeting, to cover some of the time involved in assessing your case. If, following the meeting, you decide to instruct us, this fee will be deducted from our final invoice. We also offer home or hospital visits at no additional cost to the elderly or to those otherwise unable to visit our office.

If you are shopping around for price comparisons, please bear in mind that we believe we offer a premium, personal service to our clients, as our testimonials show. If you instruct us, you will be allocated a highly trained, highly experienced and fully qualified Solicitor who will be responsible for your case. You will also have their direct dial telephone number and direct email address from the outset.  Do consider this when choosing which firm of solicitors to assist you.

Whilst the above applies generally to our fees, we are required to provide a more accurate and detailed cost guidance in relation to non-contentious Probate and Administration of Estates matters which we hope will assist you.

 

COSTS GUIDANCE FOR NON-CONTENTIOUS PROBATE AND ADMINISTRATION MATTERS

We always do our best to be as accurate as we can by providing these costs guides on our website. However, each case is different and we offer a bespoke service to all of our clients. Once we have spoken with you, we will be able to provide a more accurate estimate based on your specific situation. Please be aware that these are estimated fees to provide you with guidance and the final cost may be more or less depending on the specific facts. 

The following fees apply where you are the Personal Representative. The quoted estimated fees relate only to non-contentious matters.

We offer different fee structures as follows:

LEVEL 1 -
To obtain a Grant of Probate or Letters of Administration if you provide all the information and the value of the estate is below the Inheritance Tax Threshold and where no Inheritance Tax Account is required, (this fee structure includes obtaining the Grant for you but NOT administering the Estate):

(a) What is Included:
- Meeting with you and taking instructions.
- Considering the documents provided by you
- Check validity of the Will if there is one
- Prepare Client Care Letter and Terms of Business
- Raising any enquiries with you
- Completing the probate application forms in preparation for signing by you
- Preparing the Oath for Executors/Administrators for signing by you
- Send application to the Probate Registry
- When received, send Grant to you
(b) What is not included:
- No administration of the estate is included in this fee structure
- We are not required to obtain missing information
(c) Hours to complete: 2 - 3
(d) Hourly Rate: £225.00

(e) KK Law Fees: £450 - £775 Plus VAT
(e) Disbursements:
- Probate Application Fee of £155.00 (plus .50p per additional copy of the Grant)
(f) Timescale: 3 – 5 weeks 

The above fee structure applies where:

There is one Executor or if more than one, there is no dispute between the Executors

LEVEL 2 -
To obtain a Grant of Probate if you provide all the information and the value of the estate is above the Inheritance Tax Threshold and an Inheritance Tax Account is required, (this fee structure includes obtaining the Grant but NOT to  administering the Estate):

(a) What is Included:
- Meeting with you and taking instructions.
- Considering the documents provided by you
- Check validity of the Will if there is one
- Prepare Client Care Letter and Terms of Business
- Raising any enquiries with you
- Completing the probate application and IHT Account in preparation for signing by you
- Preparing the Oath for Executors/Administrators for signing by you
- Send application to HMRC 
- Send Application to the Probate Registry
- When received, send Grant to you
(b) What is not included:
- This fee structure is to obtain the Grand of Probate/Letters of Administration but DOES NOT include any work to administer the estate
(c) Hours to complete: 4 - 5
(d) Hourly Rate: £225.00
(e) KK Law Fees: £900 - £1,125 Plus VAT
(f) Disbursements:
- Probate Application Fee of £155.00 (plus .50p per additional copy of the Grant)
(g) Timescale: 6 – 8 weeks (depending on the time it takes for HMRC and the Probate Registry to process the application) 

The above fee structure applies where:

Where there is a Will, it is valid
There is no more than one property
There are no more than four bank accounts
There are no other intangible assets
There are no disputes between Executors or Beneficiaries on division of assets
There are no claims against the Estate
There is no foreign property or assets

 

LEVEL 3 -
To obtain a Grant of Probate if you do not provide all the information and the value of the estate is above the Inheritance Tax Threshold and an Inheritance Tax Account is required, (this fee structure includes obtaining the Grant but NOT to administering the Estate):


(a) What is Included:
- Meeting with you and taking instructions.
- Considering the documents provided by you
- Check validity of the Will if there is one
- Prepare Client Care Letter and Terms of Business
- Raising any enquiries with you
- Making enquiries to establish the value of the estate
- To arranging for any valuations of the assets as required;
- Completing the probate application and IHT Account in preparation for signing by you
- Preparing the Oath for Executors/Administrators for signing by you
- Send forms to HMRC
- Send Application to the Probate Registry
- When received, send Grant to you
(b) What is NOT included
- This fee structure is to obtain the Grand of Probate/Letters of Administration but DOES NOT include any work to administer the estate
(c) Hours to complete: 6 - 8
(d) Hourly Rate: £225.00
(e) KK Law Fees: £1,350 - £1,800 Plus VAT
(f) Disbursements:
- Probate Application Fee of £155.00 (plus .50p per additional copy of the Grant)
(g) Timescale: 6 – 8 weeks (depending on the time it takes for HMRC and the Probate Registry to process the application)

 

ADMINISTERING THE ESTATE -
Administering the Estate after the Grant has been obtained:

(a) What is included:

To advising on any variation of the Will, if there is one
To completing the Income Tax Return for the period up to the date of death and the period of administration to include liaising with HM Revenue & Customs;

Advertise for creditors

To corresponding with the Executors in respect of the Estate of the assets and with the beneficiaries in respect of the administering of their inheritance;

To registering the Grant of Probate with the asset holders and collecting in the assets;

To transferring any assets within the estate or distributing the relevant assets.

The preparation of Assents in respect of properties;

To dealing with the Share Registrars in respect of any outstanding dividends;
To liaising with estate agents
To preparing the estate account;

To obtaining identification information for money laundering purposes

To undertaking bankruptcy searches against beneficiaries
To distributing the estate

(b) What is not included:

Dealing with additional assets that have not been disclosed;

Acting as agents on rental properties;

Preparing tenancy agreements;

Enforcing tenancy agreements or removing tenants;

Deeds of variation;

Dealing with HMRC in respect of undisclosed income, gifts and assets;

Dealing with HMRC in respect of any investigations they may undertake;

Challenges to the Will or disputes between Executors and/or beneficiaries or potential beneficiaries;

Obtaining affidavits

Chasing because of time delays caused by the Executors;

Any disbursements including the Probate Court Fee, Stockbroker fees, Estate Agents fees, Valuer’s fees;

Attendance at properties;

Dealing with personal effects and/or emptying of properties.

Dealing with foreign assets

(c) Hours to complete: 9 - 1
(d) Hourly Rate: £225.00
(e) KK Law Fees: £1,350 - £2,700 Plus VAT
(f) Disbursements:
- Stockbrokers fees £Depending on the value of the shares
- Land Registry Fees £Depending on the value of the property
- Valuers Fees £depending on the value of the item
- Estate Agents Fees £Depending on the value of the property, normally 1.5% - 2%
- Advertising in the London Gazette £200.00
- Bankruptcy Search £2.00 per individual
- Swear fee £7.00
(g) Timescale: 4 – 8 Months 

The above fee structure applies where:

There is a valid Will
There is no more than one property
There are no more than four bank accounts
There are no other intangible assets
There are no disputes between Executors or Beneficiaries on division of assets
There are no claims against the Estate
